The maximum price of rental properties in the middle segment will now be determined using a points system. Houses receive points for characteristics such as the surface area and the insulation of homes. The rules apply to new contracts for homes in the private sector with a rental price that, according to the points system, comes to between 880 and 1158 euros.
New tenants also receive a rental contract for an indefinite period as standard. Temporary contracts are only allowed in a few exceptional cases.
- Medium-price housing category: A new housing category will be introduced between the current regulated and liberalized categories. This medium-price category pertains to independent living accommodations. Based on the housing valuation system (WWS), the allowable rent will range between €879.66 and €1165.81 per month, effective from July 1, 2024. The same rent rules will apply to this new category as to current regulated housing, with a few exceptions.
- Tenants of deregulated housing now have more flexibility to request a rent review by the Rent Tribunal ("huurcommissie") at any time during their lease, instead of having to do it within the first six months.
- The housing valuation system (WWS) will be updated to include minus points for properties with low energy efficiency labels and modifications to the WOZ-cap (property tax value cap).
- Landlords will be required to inform tenants about the point allocation of the rented housing.
- Under the Good Landlord Act, the point allocation from the housing valuation system (WWS) will be mandatory for all independent accommodations with fewer than 187 points. This means that landlords must follow this system to determine the rent for these properties. If landlords charge excessive rents that don't comply with the WWS, they could face administrative fines up to €23,750 for the first offense.
- The rents of most social housing will increase by a maximum of 5.8 percent. If a landlord increases rent above the applicable percentage, they could be fined up to €23,750 for the first offense.
